02 Notes on passports is about to expire, can foreigners enter or exit Vietnam?

What should be noted about passports is about to expire? A passport (also known as a “hộ chiếu” in Vietnamese) is a type of document that serves as a travel document issued to Vietnamese citizens under certain conditions. With this document, you are allowed to exit the country during the validity period of the passport and re-enter Vietnam. Passports are issued by the government to citizens in accordance with the legal procedures after their request and submission of relevant documents.

Passports have a validity period ranging from 6 months to 10 years, depending on the type of passport. Passports issued to citizens who are 14 years of age or older are valid for up to 10 years from the date of issuance and cannot be extended. For passports with a 5-year validity period, if there are at least 30 days remaining before expiration, they can be extended once for up to 3 years. Passports issued to children under 14 years of age have a validity period of 2 to 5 years from the date of issuance and cannot be extended.

Based on the regulations of the Immigration Department, before going through immigration procedures to another country, your passport must be valid for entry. Currently, there are many countries that only accept passports with a validity of at least 6 months, and failing to comply with this requirement may cause various issues. Some countries may accept passports with a validity of 3 months, but a detailed itinerary of entry and exit dates must be provided, ensuring that the passport remains valid during the entire stay in that country.

According to Article 20 of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, one of the conditions for unilateral visa exemption for entry into Vietnam is that the passport must be valid for at least 6 months and must be at least 30 days beyond the date of previous exit from Vietnam.

In the case of a regular passport nearing expiration, it cannot be extended but can be reissued if it is still valid. For diplomatic and official passports, if the validity is less than 1 year, it can be extended once for a maximum of 3 years, and if it has expired, a new passport must be applied for.

Procedure for extending diplomatic and official passports:

Document requirements:

  • Diplomatic or official passport with a validity of less than 1 year.
  • One original Dispatch or Permission Letter allowing the officer, civil servant, manager, professional officer, or military officer to travel abroad according to Form 03/2016/XNC.

Receiving agency:

Submit the application directly to the Consular Department (40 Tran Phu, Ba Dinh, Hanoi) or to the local foreign affairs agency. The application will then be forwarded with the required fee to the Consular Department.

Processing time:

  • Not exceeding 2 working days from the date of receiving a complete and valid application (if submitted directly to the Consular Department).
  • If submitting the application to the local foreign affairs agency, not exceeding 2 working days from the date of receiving a complete and valid application, the local foreign affairs agency will forward the application to the Consular Department. Then, the Consular Department will process it within 2 working days from the date of receiving a complete and valid application.

Procedure for renewing a regular passport due to expiration:

Document requirements For individuals aged 14 and above:

  • Expired regular passport.
  • One completed Form X01.
  • Two recent photos, size 4cm x 6cm, with a straight face, no glasses, and white background.

Document requirements for children under 14 years old:

  • The request form for passport issuance must be certified and stamped by the local police of the commune, ward, or town where the child is permanently or temporarily residing.
  • If applying for a separate passport, provide one certified copy of the birth certificate or an extract of the birth certificate (if it is a copy, the original must be presented for verification), and two photos, size 4cm x 6cm.
  • The request form must be completed and signed by the father or mother; if the mother or father is unavailable, the legal guardian or foster parent (with legal documentation) can complete and sign on their behalf.
  • Children under 9 years old must apply for a joint passport with their mother or father, and provide one certified copy of the birth certificate or an extract of the birth certificate (if it is a copy, the original must be presented for verification), and two photos, size 3cm x 4cm.

Receiving agency for application:

  • Department of Immigration Management of the Provincial Police where the applicant’s permanent or temporary residence is located;
  • For the following cases, the application should be submitted to the Immigration Management Department:
  • Individuals who need to go abroad for medical treatment with a referral letter from a hospital;
  • Individuals whose close relatives abroad have had an accident, illness, or death and need to travel urgently for resolution, with supporting documents proving these events;
  • Officials, public servants, officers, non-commissioned officers, and employees in the People’s Army and People’s Police who have an urgent need to leave the country, with a request letter from the head of the agency or organization where they are working;
  • In case of other compelling reasons with sufficient basis, the Director of the Department of Immigration Management will consider and decide.

Processing time:

Submitting the application directly to the Immigration Management Department of the provincial or central city police where the permanent or temporary residence is located: not exceeding 08 working days from the date of submitting a complete and valid application.

Submitting the application to the Immigration Management Department: not exceeding 05 working days from the date of submitting a complete and valid application.
